A digital broadcast transmitter and digital broadcast system are provided. The transmitter includes a counter for counting transport stream packets and an information controller for determining whether or not the number of transport stream packets counted is the same as a predetermined number, and to insert packet start information according to the result of the determination. In addition to a digital broadcast transmitter, the broadcast system includes a digital broadcast receiver for receiving a transport stream from the transmitter in which the receiver reads out and processes the packet start information from the transport stream.
