A paired basis swap risk and credit mitigation system and collateral minimization system. In swaps used to hedge forward contracts a system authority interposes itself and forms paired basis swaps with each of the paired swap participants and itself together with a swaption to allow it to maintain a level book in the event of a default by any counterparty. In the event of a default the system authority has the ability to either terminate a swap and pay the non-defaulting counterparty an agreed upon termination payment, terminate the non-defaulting counterparty~s swap and exercise the swaption to substitute a correlated swap with appropriate correlated termination payment; or substitute a new counterparty with an identical swap as the paired swap participant. Paired basis swap control through delivery can be enabled to continue the risk and credit mitigation benefits of the system.
Cette invention concerne un système d'atténuation des risques dans le cas d'accords swap et un système de minimisation colatéral. A propos d'accords swap utilisés pour couvrir des contrats à terme, une autorité s'intercale et passe des accords swap réciproques avec chacun des parties prenantes auxdits accords et avec elle-même assortis d'une option sur swap lui permettant de rétablir l'équilibre des comptes en cas de défaillance de l'une des parties. En cas de défaillance, l'autorité peut soit mettre un terme à l'accord swap et verser à la partie non défaillante un paiement de cessation selon des conditions convenues d'avance, soit mettre un terme à l'accord swap avec la partie non défaillante et se substituer à cette dernière en lui versant un paiement de cessation en conséquence, ou bien substituer à la partie prenante d'origine une nouvelle partie prenante. La gestion d'accords swap réciproques jusqu'à échéance avec maintien peut se poursuivre et continuer d'offre les avantages du système en termes de protection contre les risques/crédits.
