A transport stream generating device and a transport stream generating method are provided. The generating device includes an adaptor which generates an area in a normal stream and a stuffer which constructs a transport stream by inserting an additional data stream processed to be robust against errors into the area. The transport stream includes at least one field which comprises additional data stream packets and normal data stream packets.
