Disclosed is a mobile station for determining a data rate for a packet data service in a mobile communication system including a base station, and the mobile station being provided with a voice service and a packet data service from the base station. In the mobile station, a receiver receives orthogonal code allocation information indicating the number of orthogonal codes allocated for the packet data service, a measurer measures a CIR using a received pilot channel, and a controller determines a data rate corresponding to the measured CIR, controls the determined data rate based on the number of the allocated orthogonal codes, and determines a controlled data rate. L'invention concerne une station mobile permettant de déterminer le débit binaire d'un service de rafales de données dans un système de communication mobile comprenant une station de base comportant quant à elle un service vocal et un service de rafales de données provenant de la station de base. Dans ladite station de base, un récepteur reçoit des informations d'affectation de codes orthogonaux indiquant le nombre de codes orthogonaux affectés pour le service de rafales de données, un système de mesure mesure un CIR à l'aide d'une voie pilote reçue et un contrôleur détermine un débit binaire sur le base du nombre de codes orthogonaux affectés et détermine un débit binaire contrôlé.
